SERPpost Terms of Service

Important Notice

These Terms of Service form a binding legal agreement between you and SERPpost. By accessing, registering for, purchasing from, or using the Services, you agree to these Terms, our Privacy Policy, our Cookie Policy, and all applicable laws. If you do not agree, you must not use the Services.

Note: SERPpost is an independent technical infrastructure provider. SERPpost is not affiliated with, endorsed by, or sponsored by Google, Bing, or any third-party website, publisher, platform, or search engine. Third-party trademarks, content, and data remain the property and responsibility of their respective owners.

These Terms of Service ("Terms") govern your access to and use of SERPpost, including the website, dashboard, APIs, documentation, playground, support channels, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and by all applicable laws. If you do not agree, you must not access or use the Services.

SERPpost is an independent technical infrastructure provider and is not affiliated with, endorsed by, or sponsored by Google, Bing, or any third-party website, publisher, or search engine. All third-party names, trademarks, and content remain the property of their respective owners.

1. Accounts and Eligibility

1.1 Eligibility

The Services are intended for businesses, developers, researchers, and other professional users. You represent that you are at least 18 years old and legally able to enter into a binding agreement.

1.2 Registration Information

You must provide accurate, current, and complete account information, keep it updated, and ensure that the person accepting these Terms has authority to bind the applicable business or organization. You are responsible for all activity that occurs under your account.

1.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials, API keys, and any downstream systems connected to your SERPpost account. You must promptly notify SERPpost if you suspect unauthorized access, credential leakage, account misuse, or compromise of systems that may affect the Services.

1.4 Multiple Accounts and Evasion

You may not create or operate multiple accounts to evade pricing rules, free-evaluation limits, Request Slot limits, refund restrictions, abuse controls, monitoring rules, or any other operational policy. SERPpost may correlate accounts, traffic, devices, payment signals, or other indicators to enforce this rule.

1.5 Monitoring, Suspension, and Termination

(a) Monitoring. SERPpost may monitor usage, traffic patterns, request metadata, payment events, and abuse signals to operate the Services, enforce policies, investigate fraud, and resolve disputes.

(b) Suspension for Cause. SERPpost may suspend, restrict, or terminate your account or access to the Services immediately if we reasonably believe that your activity violates these Terms, creates security or legal risk, harms the platform, harms third parties, or involves fraud, abuse, sanctions risk, or payment misconduct.

(c) User-Initiated Termination. You may stop using the Services at any time. Account deletion or discontinuation of use does not entitle you to a refund except as expressly provided in Section 4.4.

(d) Survival. Sections relating to payment obligations, refund rules, chargebacks, third-party data, logs, disclaimers, limitations of liability, indemnification, dispute resolution, and general legal provisions survive termination or expiration of these Terms.

2. License and Acceptable Use

Subject to these Terms, SERPpost grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business, development, or research use.

2.1 Prohibited Conduct

  • Reverse engineer, decompile, copy, mirror, or create derivative versions of the Services except as expressly permitted by applicable law.
  • Attempt to bypass or defeat any usage controls, credit logic, Request Slot rules, authentication, monitoring, or security protections.
  • Use the Services to violate law, infringe third-party rights, misrepresent data ownership or source, or remove copyright, trademark, or attribution notices from third-party content where such notices apply.
  • Use the Services to attack, overload, probe, interfere with, or degrade SERPpost systems or third-party services.
  • Submit malware, malicious payloads, deceptive traffic, or abusive automated workloads designed to evade safeguards or exploit the platform.
  • Use the Services to access content or systems you are not authorized to access, including bypassing login walls, private resources, or access restrictions imposed by target sites.
  • Use the Services in a manner that violates export controls, sanctions laws, anti-corruption rules, or trade restrictions applicable to you or your jurisdiction.

2.2 Enforcement

Any breach of this Section 2 is a material breach of these Terms and may result in immediate suspension or termination, credit forfeiture, refusal of refunds, and any other remedies available under law or equity.

3. Third-Party Data and Your Responsibilities

SERPpost provides technical access to publicly available search results and user-directed web extraction workflows. SERPpost does not own third-party search results, web pages, or publisher content returned through the Services.

3.1 Third-Party Content

Returned data may include text, images, snippets, links, metadata, or other material owned or controlled by third parties. SERPpost does not grant you any ownership rights in that content. You are responsible for evaluating whether your storage, display, republishing, training, fine-tuning, commercial use, or other downstream use is lawful and authorized.

3.2 SERP API Disclaimer

The SERP API retrieves data from third-party search engines in real time. SERPpost does not control search engine rankings, index coverage, snippets, layout changes, result availability, or search-engine anti-abuse measures. SERPpost does not guarantee that any specific result will appear, parse correctly, remain available, or satisfy your legal or business requirements.

3.3 Web Content Extraction Disclaimer

When you submit a URL for extraction, you direct SERPpost to access that target on your instructions. You are solely responsible for the URLs, queries, prompts, instructions, and downstream uses you choose. You represent that your use of the Services and any returned data complies with applicable law, target-site rules that apply to you, and any contractual, confidentiality, privacy, or intellectual-property restrictions relevant to your workflow.

3.4 User Obligations

Unless permitted by applicable law or the relevant rights holder, you will not, and will not permit others acting on your behalf to:

  • misrepresent the ownership or source of returned data;
  • remove, obscure, or alter copyright, trademark, attribution, or legal notices where such notices apply; or
  • use returned data in a way that infringes third-party rights, violates privacy law, or breaches site-specific restrictions binding on you.

3.5 Data Minimization, Logs, and Evidence

SERPpost follows a data-minimization posture. SERPpost does not intend to operate as a long-term archive of returned third-party payload data. However, you acknowledge that SERPpost may record usage logs, request metadata, billing records, abuse signals, and related evidence for billing, security, troubleshooting, fraud prevention, legal compliance, platform integrity, and dispute resolution.

4. Credits, Request Slots, Payment, and Refunds

4.1 Payment Model

SERPpost currently operates on a pay-as-you-go credit-pack model. Paid packs provide a defined amount of credits and a defined Request Slot allocation, as published on the live pricing page. SERPpost may introduce, modify, retire, or limit plans, promotions, credits, or concurrency allocations at any time unless separately guaranteed in a signed written agreement.

4.2 Credit Validity

Paid credits are valid for six (6) months from the purchase date unless a different validity period is expressly stated at the time of purchase. Unused credits expire at the end of the validity period and are forfeited. Credits are non-transferable, non-redeemable for cash, and may not be resold or moved between unrelated accounts.

4.3 Request Slots and Stacking

Request Slots describe how many live requests your account can run at once. The following rules apply:

  • Standard: Standard provides a fixed 2-slot allocation and does not stack like the larger paid packs.
  • Eligible Stacking: Starter, Pro, and Ultimate may add Request Slots together across eligible paid orders.
  • Automatic Detachment: When an order runs out of credits or expires, the Request Slots tied to that order are removed.
  • No Availability Guarantee: SERPpost may change concurrency logic, queueing behavior, or stacking eligibility to protect the platform.

4.4 Refund Policy

(a) Eligibility Window. You may request a refund within seven (7) calendar days of the payment date only if no more than twenty percent (20%) of the purchased plan usage has been consumed at the time the request is reviewed.

(b) Usage Measurement. For refund review, SERPpost may determine consumed usage by reference to credits used, fulfilled requests, stacked Request Slot activity, associated order activity, account-level traffic, and related system records.

(c) Non-Refundable Cases. Beyond the seven-day window or twenty-percent usage threshold, purchased credit packs are non-refundable. Refunds may also be denied where the account has been suspended for cause, where the request is abusive or misleading, or where payment misconduct or policy evasion is involved.

(d) Review Standard. Refund decisions are based on SERPpost payment, billing, and usage records, which control in the event of conflict absent manifest error.

4.5 Refund Review and Abuse

SERPpost may reject a refund request if we reasonably determine that the request is abusive, fraudulent, misleading, part of a repeat-refund pattern, or linked to account misuse, policy evasion, or chargeback misconduct.

4.6 Chargebacks and Payment Disputes

Initiating a chargeback or payment dispute after receiving access to the Services may be treated as a material breach of these Terms. SERPpost may suspend or terminate the account, revoke remaining credits, contest the dispute, and seek recovery of fees, chargeback costs, collection costs, and reasonable attorneys' fees where permitted by law.

4.7 Taxes

Unless stated otherwise, prices do not include sales tax, VAT, GST, withholding tax, or similar taxes. You are responsible for applicable taxes arising from your purchases, except taxes based on SERPpost's net income.

5. Disclaimers and Liability Limits

5.1 Services Provided As Is

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, SERPpost disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or uninterrupted operation.

5.2 No Guarantee of Third-Party Data

SERPpost does not warrant that third-party search results, extracted content, or target sites will remain available, parse correctly, be complete, or be legally reusable for your specific purpose. Upstream services may change, block, throttle, remove, or alter data at any time.

5.3 Targets Are Not Guarantees

Any uptime, latency, response-time, capacity, or performance statements on the website, pricing page, FAQ, docs, marketing materials, or support communications are service targets, examples, or estimates only unless expressly stated otherwise in a signed written enterprise agreement. They are not warranties and do not create refund or service-credit rights.

5.4 Limitation of Liability

To the maximum extent permitted by law, SERPpost and its affiliates, officers, directors, employees, contractors, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or opportunity, even if advised of the possibility of such damages. In all cases, SERPpost's aggregate liability arising out of or relating to the Services will not exceed the total fees actually paid by you to SERPpost in the twelve (12) months before the event giving rise to the claim.

5.5 Indemnification

You agree to indemnify, defend, and hold harmless SERPpost and its affiliates, officers, directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Services, your submitted URLs or queries, your downstream use of returned data, your violation of these Terms, or your violation of any law or third-party rights.

6. General Terms

6.1 Related Policies

Your use of the Services is also subject to the Privacy Policy and Cookie Policy, which form part of these Terms.

6.2 Modifications

SERPpost may update these Terms from time to time. Material changes may be posted on the website, in-product, or sent by email. Non-material edits, clarifications, corrections, or formatting changes may be made without specific notice. By continuing to use the Services after updated Terms become effective, you agree to the revised Terms.

6.3 Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules.

6.4 Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration in Seattle, Washington, before a single arbitrator administered by JAMS under its applicable rules. You and SERPpost agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, coordinated, or representative proceeding.

6.5 Force Majeure

SERPpost is not liable for delays or failures caused by events beyond its reasonable control, including outages of third-party search engines, target-site changes, hosting failures, internet backbone failures, cyberattacks, labor disputes, natural disasters, war, sanctions, government action, pandemics, or other force majeure events.

6.6 Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure by SERPpost to enforce any provision is not a waiver of that provision or of any other right.

6.7 Assignment

You may not assign these Terms without SERPpost's prior written consent. SERPpost may assign these Terms in connection with a merger, acquisition, reorganization, financing, or sale of assets.

6.8 Export and Sanctions Compliance

You may not use the Services in violation of applicable export controls, trade restrictions, or sanctions laws. You represent that you are not located in, under the control of, or acting on behalf of a restricted jurisdiction, party, or sanctions target where use of the Services would be prohibited.

6.9 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and SERPpost regarding the Services and supersede prior or contemporaneous understandings on the same subject.
